Sponsor.  The contest is sponsored by Phantom Lacrosse, Inc., 2028 E. Ben White Blvd., Ste. 2409001, Austin, TX 78741 (“Phantom”).  The contest is in no way sponsored, endorsed or administered by, or associated with, YouTube, Facebook, Twitter, Instagram or YETI.

Contest of Skill.  This is a contest (the “Contest”) where winners will be judged on their ability to demonstrate a skill.  Phantom estimates that less than 1% of Eligible Contestants will demonstrate skills sufficient to win the Prize.  

Eligible Contestants.  The Contest is open to Eligible Contestants who are residents of the United States of America.  A person is an “Eligible Contestant” if their contest entry uses an Order Number that is not associated with a contest entry that previously won the Prize and if such person has not previously won the Prize using a different Order Number.  A person who has previously won the Prize no longer qualifies as an Eligible Contestant.  A person who is under eighteen (18) years of age at the time the contest entry is submitted will only qualify as an Eligible Contestant if their contest entry is submitted and signed by their parent/guardian.  The Contest is subject to all applicable federal, state and local laws and regulations and is void where prohibited.  

How to Enter.  Enter at https://phantomlacrosse.com/contest.  The Contest begins on July 1, 2023 and ends on the earlier of December 31, 2023 or the date that all prizes have been won.  If the Contest end date is the latter, then Phantom will publicly announce the date that all prizes have been won as soon as is practicable.

Winning Entries.  An Eligible Contestant will win the Prize if their contest entry is submitted during the contest period and is judged to be a winning entry, as determined by Phantom in its sole discretion.  Phantom will evaluate a contest entry using the following general guidelines, all of which must be present: (i) starting position standing sideways to the target with the stick parallel to the ground and top-hand elbow pointing backwards, (ii) stick motion completing the first 180-degrees of motion with both hands at or above the player’s shoulders, (iii) stick motion finishing pointed at the ground, near the player’s heel, having rotated approximately 270-degrees from the start, and (iv) the path of the ball being generally level with the ground, at or above shoulder level, for at least ten (10) yards.  Only an overhand shot can be a winning entry (that is, a sidearm shot cannot win).

Evaluation of Entries.  Phantom will use its best efforts (i) to judge whether a contest entry is or is not a winning entry within thirty (30) calendar days of the date the Eligible Contestant submits a contest entry and (ii) to mail a prize within thirty (30) calendar days of judging that a contest entry is a winning entry.

Prize.  A YETI RAMBLER 18-OZ WATER BOTTLE WITH CHUG CAP as customized by Phantom (the “Prize”).  The retail value of the Prize is $35.00.

Only one request for an Order Number per name per address is valid.  A person who has previously won the Prize no longer qualifies as an Eligible Contestant.

ReleaseBy participating in the Contest in any way, a Player, or the parent/guardian of a Player if under eighteen (18), agrees to release and hold harmless Phantom and Phantom’s officers, directors, employees and agents from and against any claim or cause of action, including, but not limited to, personal injury, death or damage to or loss of property, arising out of participation in the contest, including, without limitation, any travel related thereto or receipt or use or misuse of the Prize, the Eligible Contestant‘s own negligence or the negligence of others, accidents, breaches of contract, the forces of nature or any other causes whatsoever.

Consent to Use of Image.  The Player, or the parent/guardian of the Player if under eighteen (18), retains all intellectual property rights in and to any video linked to, uploaded or otherwise made available to Phantom.  Phantom does not claim any ownership, right, title or interest in a video submitted as a contest entry (a “Contest Video”).  Notwithstanding the foregoing, by linking, uploading and/or otherwise providing a Contest Video, the Player, or the parent/guardian of the Player if under eighteen (18), grants Phantom a perpetual, nonexclusive and royalty-free right to use the Contest Video, in whole and/or in part, and to use the initials and state of the Player (e.g., “JS, Texas”), in promotional, marketing, educational and/or related uses, including, but not limited to, publicly on Phantom’s social media accounts and on the Phantom website, without payment or compensation for the use thereof.  The Player, or the parent/guardian of the Player if under eighteen (18),  hereby releases, acquits and forever discharges Phantom and Phantom’s officers, directors, employees and agents from any and all claims, demands, rights, promises, damages and liabilities arising out of or in connection with the use or distribution of the Contest Video, in whole and/or in part.

Arbitration and Choice of Law.  The Player, or the parent/guardian of the Player if under eighteen (18), and Phantom agree to arbitrate any dispute arising from these Terms & Conditions or relating to the Contest.  ARBITRATION PREVENTS YOU FROM SUING IN COURT OR FROM HAVING A JURY TRIAL.  The Player, or the parent/guardian of the Player if under eighteen (18), and Phantom agree: (i) to notify each other of any dispute within thirty (30) days of when it arises; (ii) to attempt informal resolution prior to any demand for arbitration; (iii) that any arbitration will occur in Austin, Texas; and (iv) that arbitration will be conducted confidentially by a single arbitrator in accordance with the Rules of the American Arbitration Association (“AAA”), including the AAA’s Supplementary Procedures for Consumer-Related Disputes (as applicable). The AAA’s rules are available at www.adr.org. The arbitrator has the authority to grant any remedy that would otherwise be available in court. Notwithstanding the foregoing, this section does NOT prevent the parties from seeking public injunctive relief in a court of competent jurisdiction, and the Player, or the parent/guardian of the Player if under eighteen (18), and Phantom are NOT required to arbitrate any dispute in which either party seeks equitable or other relief for the alleged unlawful use of copyrights, trademarks, trade names, logos, trade secrets or patents. The arbitrator’s award will be final and binding and judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.  Some jurisdictions may limit or prohibit arbitration agreements.  If you are a resident of such a jurisdiction, the arbitration agreement waivers above are not applicable. Unless the Player, or the parent/guardian of the Player if under eighteen (18), and Phantom agree otherwise, in the event that a court decides that any part of this paragraph is invalid or unenforceable, (i) the Player, or the parent/guardian of the Player if under eighteen (18), agree that any claim or dispute that has arisen or may arise between the Player, or the parent/guardian of the Player if under eighteen (18), and Phantom must be resolved exclusively by a state or federal court located in Travis County, Texas, (ii) the remainder of the Terms & Conditions will continue to apply, and (iii) the Player, or the parent/guardian of the Player if under eighteen (18), and Phantom agree to submit to the personal jurisdiction of the courts located within Travis County, Texas for the purpose of litigating all such claims or disputes.
